- Introduction
This web site, which is accessible via https://jobs.cpaalberta.ca (the "Web Site"), is operated by Chartered Professional Accountants of Alberta (“CPA Alberta”) with an office at 800 444 7 Ave SW, Calgary Alberta, T2P 0X8, and powered by Madgex Inc. (“Madgex”).
By accessing the Web Site users agree to these Terms and Conditions (“Terms”). If a user is or becomes a Job Seeker or Employer (as those terms are defined below), their use of the Employer Service(s) or Job Seeker Service(s) is subject to the additional terms and conditions under the headings “Additional Terms for Employers” or “Additional Terms for Job Seekers”.
If you do not accept these Terms then you must immediately discontinue use of the Web Site.
For Job Seekers, this Web Site is intended to be used by persons who are aged 18 or over who fall under the following categories:
- Designated CPA members registered in Alberta.
- Designated CPA members registered in another Canadian province.
- CPA Candidates enrolled in a CPA Professional Education Program.
- Post-secondary students seeking entry to the CPA Professional Education Program.
- Accountants seeking entry to the CPA Professional Education program.
- Accountants seeking CPA membership through a Mutual Recognition Agreement (“MRA”).
Accounts registered by “bots” or other automated methods are not permitted. If users are accessing the Web Site outside of Canada they must do so in compliance with these Terms. CPA Alberta accepts no liability for breaches of any local laws in a user’s jurisdiction and by accepting these Terms users acknowledge that it is their responsibility to ensure that any such laws are complied with.
CPA Alberta has the right but not the duty to correct any errors or inaccuracies and change or update information on the Web Site at any time without notice. CPA Alberta may terminate, change, suspend or discontinue any aspect of this Web Site at any time without notice. Without limiting the generality of the foregoing, CPA Alberta may change the availability of any feature; institute new or change existing fees or charges for the use of the Web Site or any feature thereof; add, remove, modify or otherwise change any content of this Web Site; impose limits on certain features; or restrict access to parts or all of the Web Site.

- Nature of the Web Site
The Web Site is designed so that both those looking for a job ("Job Seekers") and those person(s) or organizations with whom contact is made or who use our Web Site seeking to fill a vacant position ("Employers") in relevant industries can be brought together.
An Employer can subscribe to a variety of job posting options through the Web Site such as job posting packages and resume database access, or set up an Employer profile page which lists all the Employer's current vacancies so that they can advertise multiple positions. Together these form the basis of the online advertising service powered by Madgex provided to Employers.
A Job Seeker who registers on the Web Site can search and receive notification of jobs that match their specific job type specification. A Job Seeker may also upload their resume for database access by Employers (see Additional Items for Job Seekers below).
In order to use these services, Job Seekers and Employers must register on the Web Site and agree to comply with the Additional Terms for Employers or Additional Terms for Job Seekers, as applicable, below.
- Intellectual property rights
Users acknowledge and agree that all patents, copyrights, trademarks and all other intellectual property rights in the design, content and arrangement of the Web Site (including its text and graphics, all software compilations or underlying source code, and all other material on the Web Site) shall remain at all times owned by CPA Alberta, Madgex or their respective licensors. Users are permitted to use this material only as expressly authorized by CPA Alberta.
Reproduction of the Web Site or any part of it, in any form is prohibited except that users may:
- print or download for personal use; and
- copy the content to individual third party sites for their personal information, provided that users acknowledge the Web Site as the source of the material and users inform the third party or parties that these Terms apply and they agree to comply with them.
Provided that use is for non-commercial purposes only, limited content or material from the Web Site may be incorporated on, or shared to another web site (for example LinkedIn ,Twitter, or Facebook).
- Content
CPA Alberta does not warrant that the content of this Web Site and any downloads are virus free and recommend that users carry out their own virus checks and keep their anti-virus and other security software up-to-date. All text, resumes, postings, or images published by Job Seekers or Employers using the site, whether public or private, is the sole responsibility of the user who posted such content. CPA Alberta does not prescreen user content, and does not take responsibility for content posted on the site. CPA Alberta reserves the right to remove any content from the Web Site in its sole discretion.
- Web site links
Links to external web sites published on the Web Site is not intended to indicate that CPA Alberta has reviewed or endorses such web sites or their content and CPA Alberta accepts no responsibility for the content of any linked web site. User’s use of any linked website is governed by the terms and conditions of such third party website.
CPA Alberta may provide users with access to tools, located on other web sites over which CPA Alberta neither monitors nor has any control nor input. Users acknowledge and agree that CPA Alberta provides access to such tools "as is" and "as available" without any guarantees, representations or conditions of any kind and without any endorsement. CPA Alberta will have no liability whatsoever arising from or relating to the use of optional third-party tools.
- Use of Web Site
All users agree to use the Web Site responsibly and not to use the Web Site for any unlawful purpose, post or publish any information that is discriminatory, defamatory, obscene or offensive, or in any other way illegal or unlawful. All information users provide will be true, accurate, complete and up to date and will not mislead or be likely to mislead CPA Alberta or anyone for which the information is intended; including, without limitation, all other users of the Web Site.
Users will take all reasonable steps to ensure that all information and data files supplied, posted or published to the Web Site are free of viruses, Trojan horses, worms, engines, routines or any form of malicious coding, and will not attempt in any way to damage, disrupt, modify or otherwise interfere with the proper and intended operation of the Web Site.
CPA Alberta or Madgex may terminate or suspend use of the Web Site at any time and without warning if a user has breached, or is suspected to have breached any of these Terms.
- Liability & disclaimer
Nothing in these Terms will limit or exclude CPA Alberta's liability (if any) for fraud, personal injury or death caused by CPA Alberta's negligence, or for any other matter or other type of liability that cannot by law be excluded or limited.
Users acknowledge that CPA Alberta is reliant on the information provided by Employers and Job Seekers; therefore, CPA Alberta has no independent means of verifying the accuracy of this information and does not check its authenticity. The Web Site and its content, including but not limited to any material posted on the Web Site by a Job Seeker or an Employer or any information or service provided through the Web Site is provided “AS-IS” and “as available”. CPA Alberta disclaims all conditions, representations and warranties, whether express, implied or statutory, including but not limited to those of merchantability, fitness for a particular purpose, title and non-infringement.
CPA Alberta shall have no liability for any indirect or consequential loss or damage, or any loss of data, loss of profit, revenue or business (whether direct or indirect in each case), and no liability for direct damages in excess of the greater of $10 and amounts paid by the user for the services giving rise to the liability, that are suffered by users arising out of their use of the Web Site, the Job Seeker Services, the Employer Services or the reliance upon any content published, posted or supplied on the Web Site.
- Additional terms for Job Seekers
The terms set out in this section only apply to Job Seekers.
- Vetting
CPA Alberta has not vetted, interviewed or carried out any background checks of any kind on any of the Employers who post positions on the Web Site, and for the avoidance of doubt, CPA Alberta does not make any representation or give any warranty for the accuracy or fitness for purpose of any information on the Job Seeker Service(s) and the use of any information provided by the Job Seeker passed to Employers. If a Job Seeker has any concerns then these must be dealt with directly between the Job Seeker and the Employer.
- Conditions of access
A Job Seeker must complete the registration form accurately and include all required relevant information. If CPA Alberta is notified by any source that any of the information supplied by a Job Seeker is false then the profile will be removed from the Web Site and notification of any relevant authorities may be deemed appropriate.
Job Seekers must ensure that their password used for the Web Site is kept confidential and they must not allow any other user to possess it. A Job Seeker's account details and password are personal to them and it is their responsibility to keep this information secure, and they shall be responsible for all use of the Web Site using such account details and password. The Job Seeker will be liable for all actions performed using their account details and password.
Job Seekers are responsible for ensuring that their computer system meets all relevant computer specifications necessary to use the Job Seeker Service(s) and is compatible with the Web Site.
- Information provided by Job Seekers
Job Seekers authorize CPA Alberta and Madgex to use, store or otherwise process any personal information which relates to and identifies them, including but not limited to their name and contact details, to the extent reasonably necessary to provide the service contemplated by the Web Site. See CPA Alberta’s Privacy Policy for more details.
Job Seekers may choose to make their resume viewable and searchable by Employers who may then contact them directly through the Web Site. Job Seekers agree to the processing and disclosure of their personal information for the purpose set out above. Job Seekers may review or modify any part of their information at any time.
Job Seekers must ensure that the Personal Information provided is accurate and complete and that all contact details contain the correct name and other requested details.
- Additional terms for Employers
The terms set out in this section only apply to Employers. In the following section:
"Employer(s)" means any person, company, organization, agent, third party or firm that purchases any recruitment products and services made available through the Web Site.
"Services" means all recruitment and advertising products and services made available by Madgex from time to time.
"Database" means all Job Seeker profiles and individual resumes stored on the site for employers to search and access.
- Vetting
CPA Alberta does not carry out any checks on Job Seekers as these should be undertaken by the Employers if they decide to employ a Job Seeker. Employers will carry out all relevant background checks to confirm that the Job Seeker has all the appropriate permissions to work in Canada, or the country in question.
- Conditions of access
Access to the Web Site is conditional upon registration. If the Employer's one-off payment is accepted they are granted a non-exclusive, non-transferable listing for the service purchased. Details of prices for subscription to the Employer Services and the procedures for payment are displayed on the Web Site or are available upon request. If an Employer's account is suspended any material that the Employer has posted on the Web Site will be disabled. An Employer’s access profile never expires (username and password) until the Employer deletes the account, allowing for access to the site even when the Employer does not currently have active job postings. Employers are responsible for ensuring that their computer system meets all relevant computer specifications necessary to use the Employer Services and are compatible with the Web Site.
- Content provided by Employers
An Employer’s profile page will remain visible to Job Seekers only when the Employer has active postings on the site. Employers (where permitted) may add to, edit or delete content on the Employer's profile page(s) on the Web Site at any time. Employers may access the search facilities for Job Seeker resumes (including job seeking information), and Employers are responsible for maintaining, updating, refreshing and the accuracy of all the material concerning job vacancies posted on the Web Site.
Employers must adhere to certain rules when posting jobs on the Web Site to ensure that users who search the Web Site get results that are presented to them as clearly and as informatively as possible.
If an Employer’s job posting includes links to another site (for example, via the Web Site’s ‘apply online’ option) they are responsible for maintaining the links and for the content of the advertisement and the linked site.
Employers may not download, store, reproduce, transmit, display, copy, distribute or use the content other than in accordance with CPA Alberta’s permission. Employers agree that CPA Alberta has the right to monitor content and may edit, reject or remove content if it does not comply these Terms.
If any Services to be used within any time period are not used within that period of time they may not be carried over into any subsequent period.
It is an Employer's responsibility to re-post the vacancy if it has not been filled.
Employers must ensure to keep their password(s) confidential and shall be liable for all use of their account and password. If an Employer, or CPA Alberta, has reasonable grounds to suspect that an unauthorized user has breached an Employer’s profile then Madgex may reset an Employer’s password or suspend an Employer's use of the Services.
CPA Alberta reserves the right to edit, delete or use electronic methods to block or filter any content left on or sent to the Web Site.
Employers have sole responsibility for the content which Employers post on the Web Site and Employers shall defend, indemnify and hold CPA Alberta harmless from and against all claims, losses and liabilities (including legal costs and expenses) suffered or incurred directly or indirectly from the Employers’ content, including but not limited to Employer information, job postings and links to other sites.
- Information provided by Employers
The following applies to any information Employers provide to the Web Site, for example, during any registration or ordering. Employers authorize CPA Alberta or Madgex to use, store or otherwise process any personal information to the extent reasonably necessary to provide the Services of the Web Site. Employers are solely responsible in all aspects for all use of personal information supplied directly to them by Job Seekers in the form of applications and resumes pursuant to the applicable privacy legislation or laws within their jurisdiction.
- Use of Job Board profiles and resume Database
On receipt of Database access Employers may:
- search, use or download resumes from the Database using the resume search for the purpose of finding suitable Job Seekers for specific job vacancies;
- use the information about the individuals contained in the Database for the purpose of contacting them directly in relation to a specific job vacancy;
- use the information only in connection with an Employer’s own recruitment-related activities.
Employers may not use the Database to:
- supply, sell or license material from the Database, or a copy of it, to any other person, including another member of their group of companies;
- download the resume or jobs Database through any automated (e.g. 'scraping') process;
- contact the individuals on the Database, make, or allow any use of the information about those individuals, other than for finding suitable candidates for specific job vacancies.
Employers agree to delete all material from the Database upon its replacement with up-to-date material or the conclusion of their search for a suitable candidate, whichever occurs first.
Employers agree to deal fairly and professionally with individuals they may contact using information from the Database and not do anything that may bring CPA Alberta into disrepute. Employers will defend, indemnify and hold harmless CPA Alberta from and against any claim brought by an individual against CPA Alberta arising from an Employer’s breach of this obligation or any of these Terms.
