Our organization:

The Alberta Securities Commission is the industry-funded regulator responsible for administering the province's securities laws. It is entrusted with fostering a fair and efficient capital market in Alberta and with protecting investors. As a member of the Canadian Securities Administrators, the ASC works to improve, coordinate and harmonize the regulation of Canada's capital markets.

The Enforcement division enforces Alberta securities laws by investigating and prosecuting breaches of those laws with a view to stopping current misconduct and preventing future misconduct.

 

The opportunity:

Reporting to the Manager Investigations, the Securities Investigator will be responsible for conducting detailed investigations of complex matters, both individually and as part of a multi-disciplinary team, into breaches of securities laws with a focus on insider trading and market manipulation cases. 

 

Key responsibilities include:

  • Conducting complex investigations with respect to breaches of securities laws with a focus on insider trading and market manipulation, from the initial complaint through conclusion of the investigation.
  • Developing and enacting investigation plans that demonstrate strategic thinking and reflect organizational priorities.
  • Analyzing trading data for market manipulation and insider trading cases and providing recommendations on investigative steps.
  • Preparing for and conducting witness and respondent interviews, using the powers of a statutorily-appointed investigator.
  • Preparing summonses, production orders and applications for search warrants with a view to collecting relevant and focused evidence, including financial information and business records, for analysis. 
  • Engaging in critical thinking and teamwork to analyze large and complex data sets.
  • Preparing comprehensive investigation reports that provide an evaluation of the evidence in relation to potential breaches of Alberta securities laws, working closely with litigation counsel in preparing for the prosecution of cases at hearings, and testifying at hearings before ASC panels or in court.
  • Cooperating and consulting with police agencies, stock exchanges, self-regulatory organizations, securities regulators (nationally and internationally), reporting issuers, and other entities.
  • Occasionally travelling within Alberta and elsewhere to conduct interviews and obtain evidence.

 

The ideal candidate will possess:

  • A post-secondary degree in Business, Finance or a related area.
  • Five to ten years or more of experience in conducting investigations.   
  • Direct experience in ensuring compliance with legislation and other regulatory requirements, preferably in relation to securities or corporate matters.
  • Sound understanding of trading, order flow and market mechanics for the equities and derivatives market.
  • Proven experience in analyzing trade data to identify market abuse behavior.
  • Applicants without investigative experience but who have five or more years in the securities industry with a solid knowledge of capital markets, securities laws, trading systems, and current trading practices and possess other relevant professional credentials (e.g., CFE, CPA, CFA) will also be considered.
  • Successful completion of the following courses is a strong asset: Canadian Securities Course, Conduct and Practices Handbook Course, Traders Trading Course, Equity Trading and Sales Course and the Derivatives Fundamentals Course. 
  • Proven experience in a team environment demonstrating professionalism, confidentiality, problem solving, critical thinking skills and innovation is preferred.
  • The ability to be agile, creative and solve problems in a fast-paced, dynamic work environment.
  • Effective communication skills, verbally and in writing.
  • Proven experience with investigative and/or compliance activities such as interviewing, researching, gathering and handling evidence, documentation of findings and providing recommendations is highly preferred.
  • Previous experience giving evidence in court or administrative proceedings would be an asset.
